Temporary residence authorization in Spain"},"content":{"rendered":"<p><span style=\"color: initial;\">Publicado: 22-05-2024<\/span><\/p>\n<section>\n<h2>What is &#8220;&#8221;arraigo&#8221;&#8221;?<\/h2>\n<p><em>Arraigo<\/em>\u00a0refers to a special kind of temporary residency permit that is granted to foreigners who at the time of application are not authorized to be in Spain and who have some kind of special circumstance. The ability to apply for <em>arraigo\u00a0<\/em>is governed by Article 31.3 of the <em>Ley Org\u00e1nica 4\/2000<\/em>\u00a0which grants the administration the power to give this type of temporary residence permit to applicants who meet the criteria. There are currently four types of <em>arraigo<\/em>\u00a0each of which have different requirements and benefits. The four types of <em>arraigo<\/em>\u00a0are social, family, labor and training. The differences between each are outlined below.\u00a0<\/p>\n<h2>What are the general eligibility requirements?<\/h2>\n<p>While the different forms of <em>arraigo<\/em> have different requirements, there are some requirements that are constant regardless of which <em>arraigo<\/em> you apply for. These general eligibility requirements include:\u00a0<\/p>\n<ul>\n<li>Not being an EU, EEA, or Swiss citizens<\/li>\n<li>A clean criminal record for any and all countries in which the applicant has resided in the past 5 years<\/li>\n<li>Not be prohibited from entering Spain<\/li>\n<li>Not being in a period of &#8220;&#8221;no return&#8221;&#8221; to Spain* (This is a 3 years period that occurs once a foreigner requests Spain`s help to return voluntarily to his country)\u00a0<\/li>\n<\/ul>\n<h2>What are the differences between the types of <em>arraigo<\/em>?\u00a0<\/h2>\n<table>\n<tbody>\n<tr>\n<td>\u00a0<\/td>\n<td>Social<\/td>\n<td>Labor<\/td>\n<td>Family<\/td>\n<td>Training<\/td>\n<\/tr>\n<tr>\n<td>Who is it for?<\/td>\n<td>Foreigners who have strong social ties to Spain<\/td>\n<td>Foreigners who have a work-related tie to Spain<\/td>\n<td>Foreigners with family ties to Spain<\/td>\n<td>Foreigners who are going to complete a training program in Spain<\/td>\n<\/tr>\n<tr>\n<td>Is there a prior residency requirement in Spain?<\/td>\n<td>3 years<\/td>\n<td>2 year, with at least 6 months during this time spent working<\/td>\n<td>No<\/td>\n<td>\n<p>2 years<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td>What are the requirements?<\/td>\n<td>\n<p>1. Family ties to other foreigners living in Spain; or a form signed by the community or city hall stating that the applicant has integrated himself into the community\u00a0<\/p>\n<p>2. A work contract guaranteeing at least a minimum wage salary*<\/p>\n<p>*The applicant may be exempted from the work contract requirement if they can show that they have sufficient financial resources to remain in Spain without working<\/p>\n<\/td>\n<td>\n<p>1. The applicant must demonstrate that they have been living continuously in Spain for the past 2 years<\/p>\n<p>2. Additionally, it must be shown that during this time the applicant worked for a period of at least 6 months<\/p>\n<\/td>\n<td>\n<ul>\n<li>Be the parent or legal guardian of a Spanish child whom you have live with and take care of; or<\/li>\n<li>Be the child of a Spanish national; or<\/li>\n<li>Be the spouse or partner of a Spanish citizen; or<\/li>\n<li>Be the parent\/grandparent (&gt;65 years old) or dependent (&lt;21 years old) of a Spanish citizen or their spouse. If a Spanish citizen is the primary caretaker of someone else the age limits do not apply; or<\/li>\n<li>Have the power of attorney for a Spanish national whom you reside<\/li>\n<\/ul>\n<\/td>\n<td>\n<p>This permit is contingent upon enrolling in an approved training program, in addition to the applicant having lived in Spain for the past 2 years<\/p>\n<p>During the 2 year period before the applicatiion, the applicant must not have spent more than 90 days outside the country\u00a0<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td>Does the permit confer the right to work?<\/td>\n<td>Yes<\/td>\n<td>Yes<\/td>\n<td>Yes, for the same duration as the residency authorization<\/td>\n<td>No<\/td>\n<\/tr>\n<tr>\n<td>How long is the residency permit valid for?<\/td>\n<td>1 year<\/td>\n<td>1 year<\/td>\n<td>\n<p>1 or 5 years depending on the case.\u00a0<\/p>\n<p>Permits granted as the result of being the child of a Spanish parent are valid for 1 year. All others are valid for 5 years.<\/p>\n<\/td>\n<td>1 year, but if the training program is longer, the permit can be extended up to an additional 12 months<\/td>\n<\/tr>\n<tr>\n<td>What happens once the permit expires?<\/td>\n<td>It can`t be renewed. However, once the applicant has finished his trianing, he will be eligible to apply for a 2 year work permit if he has a job contract<\/td>\n<\/tr>\n<tr>\n<td>Required Documents<\/td>\n<td>\n<p>1. Official Application Form\u00a0<\/p>\n<p>2. Copy of passport or other travel document with a validity of at least 4 months<\/p>\n<p>3. Clean background check for all countries lived in within the past 5 years<\/p>\n<p>2. Receipt of payment for the application fee<\/p>\n<p>*All required documentation must be translated to Spanosh if it was originally in another language. Additionally, documents provided from countries other than Spain must have the Apostille seal<\/p>\n<p>Documents proving social integration and residency may include:\u00a0<\/p>\n<ul>\n<li>Padron certificate<\/li>\n<li>Proof of medial appointments<\/li>\n<li>Receipts from local businesses<\/li>\n<li>Study certificate<\/li>\n<li>Rent receipts<\/li>\n<li>Proof of Spanish language classes<\/li>\n<li>Proof of friendships with other foreigners or Spaniards in the community<\/li>\n<\/ul>\n<\/td>\n<td>\n<p>1. Additionally, documents provided from countries other tan Spain must have the Apostille seal<\/p>\n<p>If the work was completed legally, then proper documentation will not be an obstacle<\/p>\n<p>However, in cases where the employment was not official, it if more difficult to provide proof. Before applying for the <em>arraigo<\/em>, the application should amke a <em>denuncio<\/em> against the employer stating that the worked illegally. After this processm it will be easier to apply.<\/p>\n<p>Documents proving work may include:\u00a0<\/p>\n<ul>\n<li>a conciliation by the employer<\/li>\n<li>a judicial decision\u00a0\n<ul>\n<li>an administratie decision related to the employment being unauthorized<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/td>\n<td>\n<p>1. Additionally, documents provided from countries other than Spain must have the Apostille seal<\/p>\n<p>Documents showing family ties depending on the case:\u00a0<\/p>\n<ul>\n<li>Parent\/Guardian of Spanish Child: child`s birth certificate with nationality\u00a0<\/li>\n<li>Power of Attorney for a Spanish person: DNI of the Spaniard plus documentation showing that this person is not capable of being their own power of attorney<\/li>\n<li>Additionally, it must be shown that the applicant lives with that person<\/li>\n<li>Family Members of Spaniards: spouse-marriage certificate, domestica partner-official registration, dependent family members-certificate of dependency<\/li>\n<li>Children of Spanish Parent: birth certificate of the Spanish parent and the applicant<\/li>\n<\/ul>\n<\/td>\n<td>\n<p>1.
